Greenford grocer must pay £111K to woman who slipped on grapes

Sun 05 Aug 2012
A Greenford grocer must pay £111K to woman who slipped on on "mushy" grapes outside his shop.

Mrs Samira Hassan, 57, was browsing for fruit outside The Stall in Greenford Broadway in November 2005.

She slipped on loose grapes left lying on the pavement and fell face first. To break her fall, she put out both of her arms but ended up fracturing both of her wrists.

She sued the owner, Onkar Singh Gill, claiming that she slipped on grapes that were "trodden in and mushy".

In September last year a County Court judge ordered him to pay Mrs Hassan £111,859 in compensation.

Mr. Gill appealed against the decision arguing that his staff had taken all reasonable steps to ensure the area was kept clear of fruit debris.

But the Appeal Court upheld that ruling. Lord Justice Lloyd said: "The judge did not misdirect himself on the law, nor did he make any factual findings which were not justified by the evidence."

Asked to comment after the hearing, Mr Gill said: "I wouldn’t waste my breath."
